Terms of Service

These terms explain the basic rules for using ACBA Directory, including accounts, listings, public directory publication, and paid memberships.

Effective date: March 20, 2026

1. Who these terms apply to

These Terms of Service govern access to and use of the ACBA Directory platform operated by Australian Christian Business Awards, including the public website, member dashboard, business listing tools, directory pages, and paid membership features.

By accessing or using the platform, you agree to these Terms. If you are using the platform for a business or organisation, you confirm that you have authority to bind that business or organisation.

2. Platform purpose

ACBA Directory is a directory platform designed to help users discover and support Christian-owned or faith-led businesses and to help approved businesses maintain a public directory listing.

The platform may include free and paid features, including account registration, listing management, public listing publication, subscription billing, founding-member offers, and account settings.

3. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into a binding agreement to use the platform.

  • You must provide accurate account and listing information.
  • You are responsible for your login credentials and account activity.
  • You must keep your details up to date.
  • You must not create accounts using false or misleading information.

4. Listings and user content

You retain responsibility for the content you submit or publish, including business names, descriptions, contact details, logos, social links, and any other listing information.

  • You must have the right to publish any content you submit.
  • Your content must be accurate, lawful, and not misleading.
  • You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, and distribute your content as needed to operate, promote, and improve the platform.
  • We may review, reject, unpublish, or remove listings that are incomplete, unlawful, misleading, infringing, or inconsistent with platform standards.

5. Public directory exposure

If your listing is published, some of the information you provide may be made publicly available through the directory, search pages, and business detail pages. This may include your business name, category, description, website, contact details, city, state, logo, social links, publication date, and membership-related badges or status.

You are responsible for deciding what information you submit for publication. Do not include confidential or sensitive information in listing fields intended for public display.

6. Paid plans, billing, cancellation, and refunds

Paid memberships are billed through Stripe. By purchasing a paid plan, you authorise Stripe and us to process the applicable subscription charges, renewals, taxes, and related billing adjustments in accordance with your selected plan.

  • Pricing, plan features, and offers may change going forward.
  • Your billing status and renewal details may appear in your account.
  • Unless the law says otherwise, fees are non-refundable once charged.
  • You can cancel future renewals through the billing tools we provide or by contacting support@acbadirectory.com.
  • Nothing in these Terms excludes any non-excludable rights you may have under applicable law, including Australian Consumer Law where it applies.

7. Acceptable use

You must not use the platform to:

  • break the law or encourage unlawful conduct;
  • post false, deceptive, defamatory, abusive, or infringing content;
  • interfere with platform security, availability, or performance;
  • scrape, copy, harvest, or bulk extract directory data without our written permission;
  • upload malicious code, attempt unauthorised access, or bypass access controls;
  • use the platform in a way that harms users, listed businesses, or the platform’s reputation or mission.

8. Intellectual property

The platform, including its software, branding, layout, text, and design elements, is owned by us or our licensors and is protected by intellectual property laws. Except as these Terms allow, you may not copy, modify, distribute, reverse engineer, or create derivative works from the platform.

Your business name, logos, and listing materials remain yours, subject to the licence you grant in these Terms.

9. Availability and third-party services

We may update, suspend, or discontinue any feature at any time. We do not guarantee uninterrupted availability, error-free operation, search ranking, or business results.

The platform depends on third-party services including Supabase, Stripe, email providers, and hosting infrastructure. We are not responsible for failures caused by third-party systems outside our reasonable control.

10. Disclaimers and limitation of liability

The platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee that directory listings are complete, accurate, suitable, or endorsed by us.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or loss-of-profit damages, or for loss of data, goodwill, revenue, or business opportunities arising from or related to your use of the platform.

If liability cannot be excluded, our aggregate liability is limited to the greater of the amount you paid us for the relevant service during the 12 months before the claim arose, or AUD 100.

11. Suspension and termination

We may suspend, restrict, unpublish, or terminate access to the platform immediately if we reasonably believe you have breached these Terms, created risk for the platform or other users, failed to pay applicable fees, or used the platform unlawfully.

You may stop using the platform at any time. Termination does not affect rights or obligations that by their nature should survive, including payment obligations, accrued claims, intellectual property, disclaimers, and liability limits.

12. General terms

  • These Terms and our Privacy Policy form the entire agreement between you and us regarding the platform.
  • We may update these Terms from time to time. Continued use after an update takes effect means you accept the revised Terms.
  • If any provision is unenforceable, the rest of the Terms will remain in effect.
  • These Terms are governed by the laws of New South Wales, Australia, and disputes will be subject to the courts of New South Wales, Australia, unless applicable law requires otherwise.
